VABI connects to WhatsApp the same way WhatsApp Web does, not through the official WhatsApp Business API. WhatsApp may restrict or ban numbers that use such connections or send automated messages, especially when recipients report the messages.

By using VABI, you accept this risk. Robomarketing SRL is not liable for the restriction or ban of the number, or for the loss of conversations or of access to WhatsApp, and the subscription is not refunded in these situations.

To reduce the risk, VABI applies sending limits, pauses between messages and pauses of the automatic replies in groups. Archiving a group starts only after you confirm, for that group, that you accept this risk.

You may not use VABI for:

• unsolicited commercial messages, or messages to people who have not agreed to receive them or have asked you to stop;
• bypassing the blacklist, the opt-outs, the sending limits or other protections of the platform;
• content that is illegal, misleading, harassing or discriminatory, or that infringes the rights of others;
• archiving groups made up mainly of your employees, groups with minors, or groups on sensitive topics (health, religion, politics, sex life);
• following or archiving conversations without a legal basis of your own, for which you are responsible;
• any use that endangers the numbers of other customers or the operation of the platform.

If these rules are broken, Robomarketing SRL may suspend the affected features or the account after a prior notice that gives you a reasonable time to remedy the situation. In serious cases that endanger other numbers or the platform (for example, mass spam or illegal content), the suspension may be immediate; in that case we tell you the reason and how to contest it without delay. While suspended, you keep access to the export of your archive.

Pro plans let you save, at your choice, the text of the messages in the WhatsApp groups you follow and in the conversations you follow with specific people. For photos and files only their type is saved, without the content. Nothing is saved retroactively and nothing from the groups or conversations you do not follow.

For this data, you are the controller: you decide what you follow, for what purpose and for how long you keep it. Robomarketing SRL is the processor and processes the data only on your behalf, under the Data Processing Agreement, which is part of these terms.

You must have a legal basis for the archiving and must inform the people concerned. For groups, VABI provides an information text you can post in the group.

The archive is kept at most for the period you choose (30 days by default, at most what your plan allows) and is deleted automatically afterwards. You can export or delete it at any time from your account.

If you connect your AI assistant (for example Claude or ChatGPT) to your VABI account, it can read the archive through the connection you authorize. The messages it reads then reach the assistant provider, which processes them under its own terms, possibly outside the European Economic Area. The choice of provider and the legal basis for this transfer are yours; you can revoke the access at any time from app.vabi.ro/tokens.
